These Terms of Use govern access to and use of octobercapitalfunding.com, the information made available on the website, contact forms, business financing request forms, document-upload features, and related website services operated by OCTOBER CAPITAL FUNDING LLC. By using the website, you agree to these Terms to the extent applicable to your use.
If you submit a financing request on behalf of a business, you also represent that you have authority to provide the submitted business information and to act for the business in connection with the request. If you do not agree with these Terms, do not submit an application or use the website in a manner that requires acceptance of them.
Eligibility and Business Purpose
You must be at least 18 years old, have legal capacity to use the website, and be authorized to act for the business identified in any submitted request. The website is intended for legitimate commercial and business financing purposes.
Do not use the website to seek personal, family, or household financing. Do not submit another person's information without authority, and do not submit a business application using false ownership, identity, revenue, or document information.
Application Screening and Service Scope
October Capital Funding may use reasonable intake rules to determine whether an online request falls within the commercial financing services we currently handle. We may stop, defer, or route a request to manual review when information indicates that the request is personal-purpose, materially incomplete, inconsistent, abusive, automated, fraudulent, outside currently supported financing categories, or otherwise unsuitable for online processing.
The application does not require an applicant to choose the final financing product. A financing preference may be provided for context, but October Capital Funding may discuss a different structure or provider program based on the business profile, requested amount, provider availability, and information obtained later in the process. A requested amount that exceeds a displayed product range does not by itself prevent submission of the application.
Website screening is not underwriting, a credit decision, or a promise of eligibility. Independent financing providers apply their own current criteria and can request additional information, offer a different structure, or decline a transaction.
Our Services and Role
October Capital Funding helps business owners understand common commercial financing categories, organize an initial request, communicate supporting information, and connect potentially eligible requests with independent financing providers or commercial finance partners.
Our role can vary by request and provider. We may discuss product categories, collect documents, request clarification, facilitate a referral, or help coordinate follow-up. Independent providers apply their own underwriting criteria and determine whether they will present a financing option.
Website Information Is Not a Financing Offer
Website content, program descriptions, example ranges, calculators, educational materials, emails, telephone discussions, and initial application steps are provided for general commercial-financing purposes. They do not create a binding commitment to provide financing.
Submitting an application does not guarantee approval, a provider match, a particular amount, rate, fee, payment amount, term, total cost, closing date, or funding timeline. An actual financing option exists only if an independent provider communicates the option under its applicable process and provides the required transaction documents.
Application Information and Applicant Responsibilities
You agree to provide information that is accurate, complete, and not intentionally misleading to the best of your knowledge. You must be authorized to provide all business records and documents submitted through the website.
Business circumstances can change during a financing review. If material information changes, including revenue, ownership, business status, existing obligations, or the intended use of funds, you should provide updated information when reasonably requested. A provider may independently verify information and may decline a request if required information cannot be verified.
Processing and Provider Sharing
When you provide the application authorization presented on the website, you authorize October Capital Funding to review and process the submitted information and to disclose relevant information and supporting documents to financing providers and service providers when reasonably necessary to evaluate, verify, administer, or respond to the commercial financing request.
The authorization does not mean that every provider will receive every application. We may consider product fit, program availability, business profile, geography, documentation, and other factors when deciding which provider relationships may be relevant.
Credit Reports and Separate Authorizations
The standard website consent is not intended to operate as a blanket authorization for October Capital Funding or every possible provider to obtain a personal consumer credit report. If a provider or process requires a personal credit report, bank verification, or other sensitive verification, additional authorization may be presented separately as required by the applicable process and law.
You should review any credit authorization before accepting it and understand which organization is requesting the information and for what purpose. Provider-specific authorizations may be governed by the provider's own application terms and privacy notice.
Documents and Sensitive Information
The application requests supporting commercial documents based on the information entered. The current checklist generally includes recent business bank statements and a voided business check, can request processing statements for a receivables-based preference, and can offer additional financial-statement fields for larger requests. Provider requirements may differ, and additional documents may be requested after submission.
Documents are uploaded individually to private Vercel Blob storage as temporary staging files and then delivered with the application through authenticated Hostinger Email SMTP. The current secure upload workflow limits each individual file to 3.5 MB and the combined active document package to 15 MB. The website may assign each attachment a distinct application-based filename so documents remain identifiable even when original filenames are the same.
Do not submit online-banking usernames or passwords, one-time authentication codes, debit-card PINs, CVV values, or security-question answers through this website or ordinary email. If a provider requires Social Security number, date of birth, government identification, credit authorization, or similar sensitive identity information, use the secure process specified for that request.
You are responsible for confirming that documents submitted on behalf of a business may lawfully be shared for the financing purpose described in the application.
Electronic Signature for the Website Request
The financing request may ask you to type your name and affirm that the typed name is intended as your electronic signature. When you do so and submit the application, we may record the typed name, submission date and time, application reference, consent versions, and technical submission information as part of the application record.
This electronic signature applies to the October Capital Funding website request and the authorizations presented with it. It does not by itself execute a later financing-provider agreement, credit authorization, guaranty, or other provider-specific contract. A financing provider may require its own application, disclosures, consent, or e-signature process.
Provider Agreements Control
If an independent financing provider presents an option, the provider's written offer, transaction disclosures, and financing agreement control the actual transaction. Website descriptions and conversations with October Capital Funding do not replace or modify the provider's written documents.
Before accepting financing, review the amount actually delivered, total cost or repayment, payment or remittance frequency, term or estimated duration, fees, collateral, liens, guaranties, reconciliation rights where applicable, prepayment provisions, default remedies, and other material terms. Ask questions before signing a document you do not understand.
Compensation and Fees
October Capital Funding may receive compensation from a financing provider, referral partner, or other commercial party in connection with a referral, application, or completed transaction. Compensation may vary by provider, product, transaction size, or contractual arrangement.
October Capital Funding does not solicit an advance broker fee from a business through this website. A provider or independent third party may have legitimate charges associated with a commercial transaction, such as appraisal, filing, closing, legal, verification, or similar costs. Any such charge should be reviewed in the applicable written documents and verified before payment.
Electronic Communications
By submitting contact information in connection with a financing request, you agree that we may use that information to communicate about the request, documents, clarification, provider follow-up, status, and other service-related matters through reasonable channels such as telephone and email.
These Terms do not by themselves create consent for unrelated automated promotional text messages where separate consent is legally required. If an optional marketing communication program is introduced, the applicable consent and opt-out information will be presented separately.
Privacy
Our Privacy Policy describes how information submitted through the website may be collected, used, disclosed, protected, and retained. The Privacy Policy is incorporated into these Terms by reference for purposes of website use.
Financing providers and other third parties may maintain their own privacy notices and data-handling practices. Review those notices before providing information directly to a third party.
Third-Party Services and Links
The website may rely on or link to third-party services, financing providers, government resources, form processors, document portals, or other external websites. We do not control their availability, security, content, privacy practices, or contractual terms.
